Terms of Service

Effective September 20, 2026. These terms are between Belmont Labs Inc. ("EMRfi," "we") and the healthcare organization that creates an EMRfi account ("Provider," "you").

1. What EMRfi is

EMRfi is a software service that lets a Provider offer its patients the option to pay a balance over time through a third-party pay-over-time provider, and that delivers the funded amount to the Provider. EMRfi is not a bank, lender, payment plan broker, payment processor, or healthcare provider. Payment plans are provided by Affirm, Inc. or its lending partners under Affirm's own terms. Payments are processed by Stripe, Inc. under the Stripe Connected Account Agreement, which you accept when you complete payments setup.

2. Eligibility and account

You must be a licensed healthcare provider, facility, or billing entity in the United States, and the person creating the account must be authorized to bind you. You are responsible for everyone who uses your API key or portal login. Keep them confidential and tell us at once if either is compromised.

3. Fees

EMRfi charges no license, setup, or subscription fee to Providers. When a patient completes a payment plan, a service fee (2.9% of the balance) and the payment processor's fee are added to the plan amount and paid by the patient, so that you receive the full balance. A Provider may instead elect in the portal to absorb these fees, in which case they are deducted from your payout. Fee rates are shown in the portal and may change with 30 days' notice; changes never apply to sessions already created.

4. Your responsibilities

5. Reversals and disputes

You may void an unused link or reverse a funded session from the portal or API. A reversal refunds the patient in full, including fees, and cancels the payment plan. Chargebacks and disputes on your Stripe account are handled under Stripe's rules and are your responsibility as merchant of record.

6. Data and privacy

Our Privacy Policy explains what we collect and why. When you use EMRfi to deliver payment links, EMRfi receives limited patient contact and payment information and acts as your business associate under the Business Associate Agreement you accept at signup.

7. Availability and support

We aim for continuous availability but do not guarantee it. Support is available through our contact form. We may suspend an account that appears to be used unlawfully, to send PHI, or in breach of these terms, and will tell you why.

8. Term and termination

Either party may end this agreement at any time on written notice. Sessions already funded remain subject to these terms, and you remain responsible for reversals and disputes on them.

9. Disclaimers

EMRfi is provided "as is." We do not warrant that a payment plan will be offered or approved for any patient, that the service will be uninterrupted, or that it is fit for a particular purpose. Approval decisions are made by Affirm alone.

10. Limitation of liability

To the extent permitted by law, EMRfi's total liability under these terms is limited to the service fees EMRfi earned from your account in the twelve months before the claim. Neither party is liable for indirect, incidental, or consequential damages.

11. Indemnity

You will defend and indemnify EMRfi against claims arising from balances you submit, your communications with patients, or your breach of these terms or applicable law.

12. General

Texas law governs these terms; disputes are heard in the state or federal courts in Bexar County, Texas. We may update these terms with 30 days' notice in the portal; continued use after that is acceptance. If any part is unenforceable, the rest stands.
